Sign on to protect babies from toxins in diapers

California parents have no way to know what chemicals their babies are exposed to in diapers, and most manufacturers aren’t telling them. Organizations across the state are calling on the Governor and legislative leaders to change that.

Why This Matters

Studies show diapers can contain phthalates and volatile organic compounds, chemicals that impair child development. Yet California has no law requiring manufacturers to disclose what’s in them.

Subject: Requesting Support for AB 1901 (Berman) — Children’s Diapers: intentionally added ingredients: disclosure. 

Dear Governor Newsom, Pro Tem Limón, and Chair Cervantes, 

We, the undersigned organizations, are pleased to support AB 1901 (Berman), legislation that requires children’s diaper manufacturers to label all intentionally-added ingredients in children’s diapers sold, distributed, or manufactured in California.  

The Food and Drug Administrationdoesn’tregulate diapers as medical devices, although it regulates adult incontinence products as such. Instead,baby diapersfall under the purview of the Consumer Product Safety Commission.The Commissionrequiresbaby diapersto betested forlead butdoes not require manufacturers to test for a variety of other harmful chemicals ordisclosetheir ingredients.   As such, many diaper companies do notdiscloseall their products’ ingredients, leaving caregivers unable to make informed decisionsabout products that continuously touch theirbaby’s skin.  

Babies and toddlers are especially vulnerable to harmful chemicals because their bodies and skin are still developing, making exposure risks more concerning.Additionally, the skin around their genitals is very thin,exacerbatingthe risks from constant exposure to harmful substances in diapers. 

Recent testing shows that many diapers are made with ingredients linked to health concerns, like hormone-disrupting phthalates, volatile organic compounds (VOCs), and even formaldehyde. By requiring ingredient transparency, this legislation will empower parents and caregivers to make informed choices about the diapers they choose to keep their babies clean and dry.  

Alongside Assemblymember Berman and bill co-sponsors Environmental Working Group, Consumer Reports, and Center for Environmental Health, Children Now has worked with a diverse group of stakeholders to ensure that AB 1901 would fill the information gap about what is really in the diapers parents and caregivers choose for their babies. 

For the reasons outlined, we urge you to support AB 1901 to protect California babies from exposure to harmful chemicals on their sensitive skin.

  • What happens after I sign on? Your organization’s name and logo (if applicable) will be added to the letter in support of diaper ingredient transparency (AB 1901), which will be delivered to the California Senate Pro Tem, the Senate Appropriations Committee Chair, and the Governor at strategic points in time throughout the current legislative session. You can click here to see an example of how organization names and logos appear on letters like these.  
  • Does my organization need to be part of The Children’s Movement to sign on? No. Any organization that supports the issue of diaper ingredient transparency can sign, whether or not you’re a current Children’s Movement member. We hope you’ll consider joining the Movement after this campaign, but it’s not a requirement to add your organization name. 
  • Does my organization have to be based in California? No, but most signers will be. National organizations with a stake in California children and youth are welcome to sign. 
  • Can individuals sign on, or is this for organizations only? For this campaign, sign-ons are limited to organizations. Letters to California’s leaders carry the most weight when they speak with the collective voice of organizations from different communities and sectors across the state. If you’re an individual who wants to help, the most useful thing you can do is share the campaign with organizations in your network and encourage them to add their name. 
  • My organization is a 501(c)(3) nonprofit — can we sign on? Yes. Signing a letter urging legislative action is considered direct lobbying under IRS rules, but 501(c)(3) public charities are permitted to engage in a limited amount of lobbying, and a single sign-on falls well within that threshold for most organizations. If your organization has questions about your specific lobbying limits, we recommend checking with your legal counsel or board.
